Employee who refused to write an incident report – again
May an employee who had previously been required to submit an incident report refuse to submit again after being directed by the employer do so for the second time?
No, an employee cannot refuse a lawful order by the employer. As a general rule, an employee is required to comply with the lawful order of the employer. By way of exception, the employee may refuse to comply if it is not lawful and/or would result in a criminal liability.
